Terms and Conditions

By downloading and using the Kachis Bite app, or by accessing this website, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services.

Kachis Bite reserves the right to update these terms at any time. Continued use of the app or website following such updates constitutes acceptance of the revised terms.

Kachis Bite grants you a limited, non-exclusive, non-transferable license to download and use the app on your personal device for your own use. You may not:

• reproduce, duplicate, copy, sell, resell, or otherwise exploit the app;
• modify, adapt, or hack the app or attempt to gain unauthorized access;
• remove or alter any proprietary notices, labels, or markings from the app;
• use the app for any commercial purpose or public display; or
• attempt to reverse-engineer or decompile the app.

You agree to:

• provide accurate and complete information when placing an order;
• be responsible for maintaining the confidentiality of your account and any credentials you use;
• comply with all applicable laws and regulations in your jurisdiction;
• not use the app for any illegal or harmful purposes; and
• notify us immediately if you discover any unauthorized use of your account.

Ordering and Payment: All orders placed through the app are subject to availability. Kachis Bite reserves the right to refuse or cancel any order for any reason. Payment must be completed through Paystack before your order is confirmed.

Prices: Prices are subject to change without notice. The price shown at the time of order placement is the price you will be charged. This includes the base item price, any applicable service fees, and delivery fees (for delivery orders).

Fulfilment: For dine-in orders, your food will be prepared and ready within the estimated time shown in the app. For delivery orders, the delivery address and contact information you provide must be accurate—we are not responsible for failed deliveries due to incorrect information.

Cancellation: You may cancel an order before payment is complete. Once payment is confirmed, cancellations are only possible if your order has not yet been prepared. To cancel a paid order, contact us at orders@kachisbite.com.

Refunds: Refunds for cancelled orders will be processed back to the original payment method within 3–5 business days. In cases of payment failure or app error, we will work with you to resolve the issue.

To the fullest extent permitted by law, Kachis Bite shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from:

• your use or inability to use the app or website;
• any errors, omissions, or inaccuracies in content;
• delays in order preparation or delivery;
• food quality or allergic reactions;
• third-party services (Paystack, Google Maps, delivery riders);
• loss of data or unauthorized access to your device; or
• any other cause beyond our reasonable control.

Our total liability to you for any claim shall not exceed the amount you paid for the order in question.

Our app integrates with the following third-party services:

• Paystack: Payment processing. Your card details are handled by Paystack under their privacy and security terms.
• Google Maps Platform: Address lookup and delivery mapping. Use is governed by Google’s terms.

We are not responsible for the performance, security, or policies of these third parties. Use them at your own risk and review their respective terms.

You agree to indemnify and hold harmless Kachis Bite, its owners, staff, and service providers from any claims, damages, costs, or expenses arising from:

• your violation of these terms;
• your use of the app or website;
• your order or delivery;
• your interaction with other users or third parties; or
• any content you provide or transmit.

These Terms and Conditions are governed by and construed in accordance with the laws of Nigeria, without regard to its conflict of laws principles. Any legal action or proceeding shall be brought exclusively in the courts of Nigeria, and you irrevocably consent to the jurisdiction and venue of such courts.

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, that provision shall be struck, and the remaining provisions shall remain in full force and effect.
